§ 1 Provider Information

§ 2 Subject of the Agreement
HomeyHomes rents furnished serviced apartments for commercial short-term use, including short- and mid-term stays.
§ 3 Formation of Contract
The contract is concluded through the guest’s online booking and subsequent booking confirmation by HomeyHomes.
Bookings are binding.
§ 4 Duration of Stay
Stays of more than 30 days are possible.
The guest does not acquire any tenancy rights or protection under German residential tenancy law at any time.
§ 5 Prices and Payment
Full payment of the total price is due before arrival.
Accepted payment methods are displayed during the booking process.
§ 6 Security Deposit
HomeyHomes may require a security deposit or a credit card pre-authorization.
This serves to cover damages or special cleaning costs.
§ 7 Cancellation Policy
The cancellation conditions shown in the booking system apply and form part of the contract.
Standard policy:
– Free cancellation up to 7 days before arrival
– After that, tiered fees up to 100% of the total price
§ 8 Use of the Apartment
– Parties and events are strictly prohibited.
– Smoking inside the apartment is not permitted.
– Pets only with prior written approval.
§ 9 House Rules
The house rules displayed on the website and/or in the apartment form part of the contract.
§ 10 Registration Law / Guest Records
The guest is obligated to provide all legally required registration data in accordance with the Federal Registration Act (Bundesmeldegesetz).
§ 11 Damages and Guest Liability
The guest is liable for all damages caused by them or their accompanying persons.
HomeyHomes may charge damages against the deposit or the stored credit card.
§ 12 Limitation of Liability (HomeyHomes)
HomeyHomes is liable only for intent and gross negligence.
No liability for:
– loss of personal belongings
– interruptions of internet services
– force majeure
§ 13 Smart Lock / Digital Access Codes
– Access codes may not be shared with third parties.
– In case of suspected misuse, access may be blocked immediately.
– Any resulting costs must be borne by the guest.
§ 14 Cleaning / Final Cleaning
A mandatory final cleaning fee applies. The amount depends on the apartment and is clearly displayed prior to booking.
Final cleaning covers normal usage.
Extraordinary contamination is not included, such as:
– heavy residues (food, liquids, bodily fluids)
– persistent odors (smoking, cooking, pets)
– excessive or improper waste disposal
– damage or unusual condition after parties or group stays
Special cleaning, odor removal, upholstery/carpet cleaning, or additional measures will be charged based on actual effort.
§ 15 Force Majeure
In cases of force majeure, no claims can be made against HomeyHomes.
§ 16 Data Protection
The current privacy policy on the website applies.
§ 17 Place of Jurisdiction
For merchants, the place of jurisdiction is the registered seat of HomeyHomes.
For consumers, statutory jurisdiction applies.
§ 18 Corporate Bookings / B2B Clients
There is no right of withdrawal for B2B bookings.
The booking company is jointly and severally liable for all costs.
§ 19 Long-Term Stays over 30/90 Days
– No residential tenancy rights / no tenant protection
– Mandatory monthly interim cleaning
– For stays exceeding 90 days, HomeyHomes may request additional documents (e.g., company confirmation or identity verification)
§ 20 City Tax / Accommodation Tax
If an accommodation tax is applied, HomeyHomes will pass it on to the guest.
Business travelers may be able to apply for exemption.
§ 21 Energy Consumption
Normal usage is included.
Excessive or unusually high energy consumption will be charged separately.
§ 22 Noise and Quiet Hours
– Quiet hours: 22:00–06:00
– Violations may result in a contractual penalty of up to €500
– In case of severe violations, HomeyHomes may terminate the contract without notice and block access
§ 23 Tradespeople / Contractors
– Must be declared during booking
– Additional cleaning may apply
– Storage of tools, materials, or hazardous substances inside the apartment is prohibited
§ 24 Video Surveillance
Video surveillance may be present in common areas of the building and will be clearly marked.
No surveillance takes place inside the apartment.
§ 25 Extended Smart Lock Rules
In case of misuse, sharing, or manipulation of the smart lock, the guest is liable for all resulting damages and costs.
§ 26 Contractual Penalty
A contractual penalty of up to €500 may be imposed for the following violations:
– parties
– smoking inside the apartment
– sharing access codes
– significant disturbances of neighbors
– breaches of essential house rules
§ 27 Waste Disposal
The guest is required to dispose of waste properly.
Special waste or improper disposal will be charged separately.
§ 28 Internet / Wi-Fi
Internet use is permitted only for legal purposes.
The guest is liable for any legal violations (e.g., copyright infringements).
§ 29 Condition Checks / Interim Cleaning
HomeyHomes may conduct regular condition checks during extended stays.
In cases of significant dirt or misuse, special cleaning will be charged.
